Affiliate program terms & conditions

These Terms and Conditions (the “Affiliate Terms”) govern participation in the Turing College Affiliate Program (the “Program”), as further described in the Program Description. The Program is operated by Turing College GmbH, Berliner Str. 80-82, 13189 Berlin, Germany, registered with the commercial register of the Local Court (Amtsgericht) of Charlottenburg under HRB 274121 B, VAT ID DE450265802 (“Turing College”, “we”, “us”).
By enrolling in the Program, you accept these Affiliate Terms. These Affiliate Terms supplement the general Turing College Terms & Conditions and the Privacy Policy, which apply to your use of our website and services. In the event of a conflict concerning the Program, these Affiliate Terms prevail.
1. Definitions
- “Affiliate” (or “Referrer”) — a person or business enrolled in the Program who refers prospective learners to Turing College. Affiliates may be private individuals, current or former Turing College learners, or professional partners such as content creators, career coaches, bloggers and other businesses.
- “Referred Person” (or “Referee”) — a prospective learner who signs up with Turing College through an Affiliate’s Referral Link.
- “Referral Link” — the unique tracking link (or code) issued to an Affiliate upon enrollment in the Program.
- “Dashboard” — the online referral tracking dashboard made available to the Affiliate via a personal access link sent by Turing College after enrollment in the Program.
- “First Learning Month” — the first calendar month of the Referred Person’s active participation in a Turing College program, starting on their official program start date.
- “Public Funding” — funding of the Referred Person’s tuition by a public or governmental body or program, for example a German Bildungsgutschein (education voucher) redeemed via the Agentur für Arbeit or Jobcenter, or a comparable public funding scheme.
- “Program Description” — the current description of the Program published by Turing College (on the Program page and/or in the Dashboard), including the applicable Reward amounts and types, eligible Turing College programs, and any program-specific conditions.
- “Qualified Referral” — a referral that meets all conditions of Section 4.
- “Reward” — the amounts described in Section 5.
- “Payment Provider” — the third-party payment service provider designated by Turing College from time to time to process Reward payouts. The current Payment Provider is named in the Dashboard.
2. Joining the Program
2.1. The Program is open to natural persons of at least 18 years of age with full legal capacity, and to legal entities. Both private individuals and professional partners (e.g. creators, coaches, agencies) may participate.
2.2. To join, you must complete the Program enrollment process. Turing College may accept or decline any application at its reasonable discretion (for example, where an applicant’s channels or methods are incompatible with Section 7).
2.3. After your enrollment is confirmed, we will send you (a) your unique Referral Link and (b) a personal access link to your Dashboard. Your Dashboard access link and Referral Link are personal to you and may not be sold or transferred.
2.4. Employees and contractors of Turing College and members of their households may not participate as Affiliates.
3. How referrals work
3.1. You share your Referral Link with prospective learners. A referral is attributed to you only if the Referred Person signs up with Turing College using your Referral Link and our tracking system records the attribution.
3.2. If more than one Affiliate refers the same person, the referral is attributed to the Affiliate whose Referral Link the Referred Person used last before signing up (“last click”), as recorded by our tracking system.
3.3. Our tracking system’s records are decisive for whether a referral has been validly attributed. Referrals cannot be claimed retroactively for sign-ups that were not made through a Referral Link.
4. Qualified Referral — conditions for earning a Reward
A referral becomes a Qualified Referral only when all of the following conditions are met:
4.1. The Referred Person is a new prospective learner — i.e. not a current or former Turing College learner and not already registered in Turing College’s admissions process at the time of the referral.
4.2. The Referred Person enrolls in a paid Turing College program and converts to a paying learner, meaning their tuition is paid either:
- a) by the Referred Person themselves (self-funded); or
- b) through Public Funding (e.g. a Bildungsgutschein).
4.3. The Referred Person completes their First Learning Month without withdrawing, being withdrawn, cancelling, or exercising a statutory or contractual right of revocation or refund.
4.4. Turing College has actually received the corresponding tuition payment for the Referred Person’s First Learning Month (from the Referred Person or from the relevant funding body).
4.5. The referral was not generated in breach of these Affiliate Terms (in particular Sections 3 and 7). Self-referrals — enrolling in a Turing College program yourself through your own Referral Link, directly or indirectly — do not qualify.
5. Rewards
5.1. Affiliate Reward. For each Qualified Referral, the Affiliate receives the Affiliate Reward stated in the Program Description in force at the time the Referred Person signs up. The Affiliate Reward is currently EUR 500.
5.2. Referee Reward. The Program does not currently offer a Referee Reward: the Referred Person receives no coupon, discount or other reward for signing up through a referral. If a Referee Reward is introduced, it will be stated in the Program Description in force at the time the Referred Person signs up, and the conditions stated there will govern it.
5.3. There is no limit on the number of Qualified Referrals an Affiliate may generate.
5.4. Rewards are gross amounts. Each Affiliate is solely responsible for declaring and paying any taxes and social charges applicable to them (including income tax and, where applicable, VAT). Business Affiliates must state VAT correctly on their invoices.
6. Payout
6.1. Timing. Unless a different payout period is stated in the applicable Program Description, the Affiliate Reward for a Qualified Referral is paid within 30 days after the end of the Referred Person’s First Learning Month, provided that the condition in Section 4.4 (receipt of payment by Turing College) has been met. If Turing College receives the tuition payment later, the 30-day period runs from receipt of that payment.
6.2. Self-billing (Gutschriftverfahren). The Affiliate Reward is settled by way of self-billing: Turing College (or the Payment Provider on its behalf) issues a credit note (Gutschrift) for each payout, which serves as the invoice for the Reward amount. By joining the Program, the Affiliate agrees to this self-billing procedure and undertakes to provide and keep updated the information required for correct invoicing (including name, address, tax status and, where applicable, VAT ID), and to object to an incorrect credit note without undue delay.
6.3. Payment Provider. Payouts are processed through our Payment Provider. To receive payouts, you must provide accurate and complete payment details and any information reasonably required by the Payment Provider (including information required for identity verification or tax reporting). Turing College is not responsible for delays caused by missing or incorrect information provided by you.
6.4. Referee coupon. The Referred Person’s coupon is issued within 30 days after the end of their First Learning Month, subject to the same conditions.
6.5. Withholding and clawback. We may withhold, reduce or reclaim Rewards where (a) the underlying referral does not or ceases to meet the conditions in Section 4 (e.g. refund, chargeback, revocation of the funding decision), (b) we reasonably suspect fraud or a breach of these Affiliate Terms, or (c) required by law.
7. Affiliate conduct
As an Affiliate, you must:
7.1. Promote Turing College honestly and accurately, and make no false, misleading or unsubstantiated claims about Turing College, its programs, prices, funding options, or career outcomes.
7.2. Comply with all applicable laws, including the German Act Against Unfair Competition (UWG), advertising and consumer protection law, and data protection law (GDPR). In particular, you must not send unsolicited electronic messages (spam) and must clearly disclose your affiliate/advertising relationship where required (e.g. labelling posts as advertising).
7.3. Not present yourself as an employee, agent or representative of Turing College, and not use Turing College trademarks, branding or content except as expressly permitted by us in writing.
7.4. Not bid on Turing College brand keywords in search advertising, register confusingly similar domains or social media handles, or place your Referral Link on coupon/deal sites without our prior written consent.
7.5. Not offer unauthorized incentives, rebates or payments to Referred Persons, and not encourage anyone to provide false information to Turing College or to a public funding body.
7.6. Only share personal data of prospective learners with us where you have a lawful basis to do so.
Breach of this Section 7 entitles Turing College to remove you from the Program with immediate effect and to void unpaid Rewards resulting from the breach.
8. Dashboard and tracking
8.1. You can track the status of your referrals (e.g. sign-up, enrollment, Qualified Referral, payout) in your Dashboard, accessible via the personal link provided after enrollment.
8.2. The data recorded in Turing College’s tracking systems is authoritative for the calculation of Rewards. If you believe your Dashboard is missing a referral, contact us within 30 days of the relevant sign-up; later claims cannot be verified and are excluded.
9. Relationship of the parties
Participation in the Program does not create an employment, agency, partnership or joint venture relationship. Affiliates act in their own name and for their own account and have no authority to bind Turing College.
10. Data protection
We process personal data of Affiliates and Referred Persons in accordance with our Privacy Policy and applicable data protection law. Payout-related data is shared with the Payment Provider to the extent necessary to process payouts.
11. Changes, suspension and termination
11.1. Either party may terminate participation in the Program at any time with effect for the future. Rewards for referrals that are already Qualified Referrals at the effective date of termination remain payable, except in the case of termination for breach of Section 7 or fraud.
11.2. We may modify these Affiliate Terms, the Program Description or the Program (including Reward amounts and types, eligible programs, payout process, Payment Provider, tracking technology and Dashboard) or discontinue the Program at any time with effect for the future. Each referral is governed by the version of these Affiliate Terms and the Program Description in force at the time the Referred Person signs up; changes apply only to referrals made after the change takes effect and do not affect Rewards already earned for Qualified Referrals. We will announce material changes in an appropriate manner (e.g. by email or in the Dashboard); continued participation in the Program after a change takes effect constitutes acceptance of the changed terms.
12. Liability
Turing College is liable without limitation for intent and gross negligence and under mandatory law (e.g. injury to life, body or health, product liability). For slight negligence, Turing College is liable only for breach of essential contractual obligations (obligations whose fulfilment makes the proper performance of the contract possible in the first place and on which the other party regularly relies), limited to the foreseeable damage typical for this type of contract. Any further liability is excluded.
13. Final provisions
13.1. Should individual provisions of these Affiliate Terms be or become invalid, the validity of the remaining provisions remains unaffected.
13.2. These Affiliate Terms, together with the documents referenced in them, constitute the entire agreement regarding the Program.
13.3. Governing law and jurisdiction. These Affiliate Terms are governed by German law, excluding its conflict-of-law rules. If the Affiliate is a merchant, a legal entity under public law or a special fund under public law, or has no general place of jurisdiction in Germany, the exclusive place of jurisdiction is Berlin. Mandatory consumer protection provisions of the country of an Affiliate’s habitual residence remain unaffected.
